Consumer Credit Act

The Consumer Credit Act maintains the competence of the Information Commissioner given in 2013 in Article 78 to exercise the supervision over creditors and credit intermediaries in the implementation of Articles 10 and 42 in the part relating to the information, collection and processing of personal information in the performance of the evaluation of the creditworthiness of the consumer which the creditor is obliged to perform prior to the conclusion of the credit agreement and prior to the conclusion of the credit agreement for an immovable property, and Articles 11 and 44 of the ZPotK-2, which regulate access to personal information from the credit rating information exchange system or indebtedness of natural persons and the protection of these information. Fines which may be imposed by the Information Commissioner for the violation of articles that they supervise are determined in Article 96 of the ZPotK-2.
